It has come to our attention that many of our dealers and resellers are still not aware of the changes and the extent of their responsibilities under the new compulsory Australian Consumer Laws.

This legislation was passed on the 1st of January 2011 and it has substantially changed your company’s warranty responsibilities. As a reseller of products under the terms of the new consumer laws, you are responsible to your customer for any product problems including warrantable actions. In short, as the last point of customer contact in a sale, you have now become the first point of contact for any product problems including warranty claims.

If you have sold your customer a product that is not supported by the person or company that sold you the product (for whatever reason) you may now be liable for the cost of any warranty repairs, or be required to replace the product, or you may have to refund the total sale price depending on the extent of the problem. Further you could be liable for other out of pocket expenses!

When you purchase products for resale, it is important you are confident that the product importer, manufacturer or distributor has the intent and financial ability to support your company in the event of a product problem, a claim for warranty or compensation. Consideration should also be given to the products you sell that may be cheaper to purchase but don’t offer the life or performance expected by your customer as the same laws apply and without guaranteed support you may have to settle the claim.
